2. Customer Obligations
- Minors are prohibited from placing orders on the Website.
- All data provided during the purchase process must be the customer’s own accurate personal information and must not belong to third parties or be fictitious. Società Agricola Monterinaldi Srl reserves the right to take legal action against any violations or abuses, in the interest of protecting all consumers.
- The customer releases Società Agricola Monterinaldi Srl from any liability arising from the issuance of incorrect fiscal documents due to errors in the data provided by the customer. The customer is solely responsible for the correct entry of their information.
3. Products
The Website offers for sale wines and other agricultural products. The sale of alcoholic beverages is reserved to persons of legal drinking age in their country of residence. By placing an order, the customer declares to meet this requirement.
4. Prices
All prices are expressed in Euro (€) and include VAT, unless otherwise stated. Shipping costs, customs duties, and any additional charges are indicated during the checkout process.
5. Shipping and Delivery
5.1 Shipping Costs
Shipping costs depend on the destination country and the number of bottles ordered. Customers are encouraged to order in multiples of 6 or 12 bottles to optimize packaging and shipping.
5.2 Delivery Times (Indicative)
- Italy: 3–7 working days
- European Union: 7–10 working days
- United States: 4–5 weeks
- Other destinations: 25–30 days
Delivery times are indicative and may vary due to customs procedures or force majeure.
5.3 Customs Duties and Import Restrictions
For deliveries outside the European Union, any customs duties, taxes, or import fees are the sole responsibility of the customer, unless explicitly stated otherwise at checkout. The customer is responsible for ensuring the products may be legally imported into the destination country. No refund will be provided if a shipment is refused, blocked, or destroyed by local authorities.
5.4 Country-Specific Restrictions
- United States:
- Alcoholic beverages cannot be shipped to Utah and Mississippi.
- Shipments to Alabama, Arkansas, Alaska, Hawaii, and Puerto Rico are subject to a surcharge.
- Canada:
- Mixed shipments of wine and oil are not allowed.
- Each shipment may include a maximum of 12 bottles of wine.
- Customs duties, taxes, and any import-related charges are never included and are always borne by the customer.
- Customs clearance requires the appointment of a licensed customs broker, at the customer’s expense.
6. Transfer of Risk
The risk of loss or damage passes to the customer upon delivery to the carrier. All shipments are insured against breakage or loss during transportation.
7. Damaged or Defective Goods
7.1 Damaged Shipments
If the parcel appears visibly damaged upon delivery, the customer must accept it with reservation or refuse delivery. Any damage must be reported within 48 hours. If the product is unavailable for replacement, the customer will receive a refund, including shipping costs.
7.2 Defective Goods
Defective goods may be returned within 10 days of delivery. Return shipping costs are borne by the customer. Replacement or refund (if unavailable) will be at the Seller’s expense.
8. Right of Withdrawal and Refunds (EU Consumers)
In accordance with Directive 2011/83/EU and Italian Legislative Decree 206/2005, customers have the right to withdraw from the purchase contract within 14 working days from receipt of the goods, without providing any reason. The withdrawal period expires 14 working days from the day the customer or a third party other than the carrier and designated by the customer acquires physical possession of the goods.
8.1 How to Exercise the Right of Withdrawal
The customer must send a clear statement of withdrawal by email to amministrazione@monterinaldi.it within 14 days of delivery, or by registered mail to Società Agricola Monterinaldi Srl – Loc. Pesanella 75, Lucarelli, 53017 Radda in Chianti (SI) – Italy.
8.2 Return of Goods
Goods must be intact and returned in their original packaging, complete with all parts. If the original packaging is damaged, it is recommended to replace it or use another box. Return shipping until confirmed receipt at the warehouse is the customer’s responsibility. Società Agricola Monterinaldi Srl is not liable for damage, theft, or loss of goods returned via uninsured shipments. Return shipping costs are borne by the customer.
8.3 Refunds
Refunds will be issued within 14 days from receipt of the withdrawal notice. The Seller may withhold the refund until the goods are received or proof of return is provided. The refund includes the price of the goods and standard shipping costs paid at checkout. Additional shipping costs (e.g., express delivery) are non-refundable.
The right of withdrawal is forfeited if the product integrity (packaging and/or contents) is not met, including:
- Partial or full use of the goods or included accessories
- Absence of external packaging or original internal packaging
- Missing integral parts of the product
- Damage not caused by transportation
The right of withdrawal does not apply to goods made to measure, clearly personalized, rapidly perishable, sealed for hygiene reasons, or related to health protection that have been opened after delivery.
8.4 Return Procedure
The registered letter or email must include:
- Invoice number
- Order number
- Products for which withdrawal is exercised
- Product code (if available)
Società Agricola Monterinaldi Srl will send a confirmation email to agree on the return method within 14 days. The customer must include a copy of the delivery document inside the package and visibly attach the document received after withdrawal communication. A copy should also be placed inside the package to avoid loss or misidentification.

10. Warranty

11. Liability
Società Agricola Monterinaldi Srl shall not be held liable for service disruptions caused by force majeure or events beyond the Seller’s control, including accidents, explosions, fires, strikes/lockouts, earthquakes, floods, or similar events that prevent timely execution of the contract. The Seller is not liable for damages, losses, or costs due to non-fulfillment for these causes. Delivery is carried out by couriers/shipping agents within normal times.
12. Applicable Law and Jurisdiction
These Terms and all disputes related to orders are governed by Italian law. The parties agree to submit any dispute to the competent court of Siena, Italy.
